Danh dự và nhân phẩm là quyền bất khả xâm phạm của con người, được quy định trong Hiến pháp và pháp luật. Tuy nhiên, cùng với sự phát triển của CNTT, hiện tượng dùng mạng xã hội để xâm phạm danh dự, nhân phẩm, uy tín của công dân đang thực sự đáng lo ngại

Facebook có nickname Vũ Chung bôi nhọ một Facebook cá nhân khác được gửi kèm theo Đơn cầu cứu gửi đến Báo Khongquantam.com.

Cuối năm 2014, trên trang mạng Facebook có một nhóm người giấu mặt liên tục đăng bài viết, hình ảnh các doanh nhân, người mẫu, nghệ sĩ trong giới showbiz với nội dung xuyên tạc, bôi nhọ, xâm hại đời sống cá nhân. Nhận thông tin tố giác tội phạm của nạn nhân, Cơ quan điều tra vào cuộc, kết cục hai phụ nữ có hành vi bịa đặt, đăng những bài viết vu khống, bôi nhọ này đã bị khởi tố về hành vi lợi dụng các quyền tự do dân chủ xâm phạm đến quyền và lợi ích hợp pháp của các tổ chức và cá nhân theo Điều 258 Bộ luật Hình sự.

Cũng trong năm 2015, Phòng Cảnh sát phòng chống tội phạm công nghệ cao, Công an Hà Nội (PC50) phát hiện và bắt giữ Nguyễn Văn Tiến (23 tuổi, sinh viên năm thứ 5 Đại học Bách khoa Hà Nội) để điều tra về hành vi lập fanpage trên mạng xã hội Facebook nhằm bôi xấu các tổ chức, doanh nghiệp.

Trước đó, Cơ quan điều tra xác định Tiến sử dụng hai tài khoản cá nhân lập khoảng 100 fanpage khác nhau nhằm mục đích bán cho doanh nghiệp nhưng không có doanh nghiệp nào hỏi mua. Do đó, Tiến đã đổi tên khoảng 100 fanpage này có nội dung bôi nhọ, nói xấu doanh nghiệp, tổ chức với nội dung như “Báo Dân Trí lừa đảo khách hàng”, “Hòa Phát Group lừa đảo khách hàng”, “VN Airport lừa đảo khách hàng”, “OceanBank lừa đảo khách hàng”… Mục đích của Tiến là nhằm tạo áp lực, buộc các đơn vị này phải mua lại fanpage với giá 100.000 – 1 triệu đồng.

Một Facebook bôi nhọ Công ty Happy Secret được gửi kèm theo Đơn cầu cứu gửi đến Báo Công lý.

Đây chỉ là một trong số nhiều vụ việc các đối tượng có hành vi vi phạm, nói xấu cá nhân, tổ chức trên mạng Internet được cơ quan chức năng phát hiện hoặc thụ lý theo đơn tố cáo của cá nhân hoặc của cơ quan, tổ chức là nạn nhân. Những vụ việc có hành vi vi phạm pháp luật hình sự đều được chuyển sang Cơ quan điều tra để xử lý theo quy định của pháp luật. Có đối tượng khi vướng vòng lao lý mới thấy bài học đắt giá bởi “chơi dao hai lưỡi”, thậm chí chỉ là “trò đùa dại dột”.

Điều 37  Bộ luật Dân sự năm 2005 quy định: “Danh dự, nhân phẩm, uy tín của cá nhân được tôn trọng và được pháp luật bảo vệ”. Bộ luật Dân sự cũng quy định, khi quyền dân sự của một chủ thể bị xâm phạm thì chủ thể đó có quyền tự bảo vệ theo quy định của Bộ luật này hoặc yêu cầu cơ quan, tổ chức có thẩm quyền công nhận quyền dân sự của mình; buộc chấm dứt hành vi vi phạm; buộc xin lỗi, cải chính công khai; buộc thực hiện nghĩa vụ dân sự; buộc bồi thường thiệt hại.

Nghị định số 72/2013/NĐ-CP ngày 15/07/2013 của Chính phủ về quản lý, cung cấp, sử dụng dịch vụ internet và thông tin trên mạng quy định: Nghiêm cấm các hành vi “Đưa thông tin xuyên tạc, vu khống, xúc phạm uy tín của tổ chức, danh dự và nhân phẩm của cá nhân; “Giả mạo tổ chức, cá nhân và phát tán thông tin giả mạo, thông tin sai sự thật xâm hại đến quyền và lợi ích hợp pháp của tổ chức, cá nhân”.

Facebook vừa gièm pha sản phẩm của Công ty Happy Secret, vừa “quảng cáo” sản phẩm cho một công ty khác (Ảnh do DN cung cấp).

Hành vi trên có thể bị xử phạt theo Nghị định số 174/2013/NĐ-CP ngày 03/11/2013 của Chính phủ quy định xử phạt vi pham hành chính trong lĩnh vực bưu chính, viễn thông, công nghệ thông tin và tần số vô tuyến điện. Theo đó, hành vi cung cấp, trao đổi, truyền đưa hoặc lưu trữ, sử dụng thông tin số nhằm đe dọa, quấy rối, xuyên tạc, vu khống, xúc phạm uy tín của tổ chức, danh dự, nhân phẩm, uy tín của người khác sẽ bị xử phạt tiền từ 10 triệu đồng đến 20 triệu đồng (Điểm g khoản 3 Điều 66).

Ngoài việc bị xử phạt hành chính, bồi thường dân sự, những hành vi bôi nhọ danh dự nhân phẩm của người khác trên mạng xã hội một cách nghiêm trọng có thể bị xử lý về hình sự về các tội Vu khống, Làm nhục người khác hoặc tội Lợi dụng các quyền tự do dân chủ xâm phạm đến quyền và lợi ích hợp pháp của các tổ chức và cá nhân.

Khi phát hiện hành vi pháp luật, người bị hại và bất cứ ai cần thu thập chứng cứ và làm đơn tố giác đến cơ quan Công an để kịp thời có biện pháp xử lý, nhằm góp phần làm trong sạch, lành mạnh môi trường mạng xã hội.

Một Lãnh đạo Phòng PC50 Công an Hà Nội cho biết việc phát hiện hành vi vi phạm của các cá nhân trên mạng xã hội có khó khăn, tuy nhiên không đến mức “bó tay”, kể cả các trang web đã thực hiện hành vi thông tin sai sự thật, vu khống người khác có địa chỉ IP đặt tại nước ngoài. “Dù hệ thống máy chủ đặt ở đâu, việc truy tìm danh tính người vi phạm khó khăn thế nào, nhưng nếu hành vi vi phạm nghiêm trọng đã xảy ra trên lãnh thổ Việt Nam thì các cá nhân, tổ chức đó chắc chắn vẫn sẽ được làm rõ và xử lý nghiêm theo quy định của pháp luật”.

Công an TP.HCM tiếp nhận thụ lý hồ sơ vụ việc theo đơn tố giác tội phạm của Công ty Happy Secret .

Trở lại vụ Công ty Happy Secret có đơn kêu cứu về việc bị một số đối tượng bôi nhọ, xúc phạm trên mạng xã hội mà Báo Công lý đã đưa tin, ngày 11/10/2016 vừa qua, Công an TP Hồ Chí Minh đã tiếp nhận đơn tố giác tội phạm của Công ty này để tiến hành thụ lý để điều tra, xử lý theo quy định của pháp luật.

Rõ ràng việc tung thông tin, hình ảnh của người khác lên mạng với mục đích xấu nhằm hạ thấp uy tín, danh dự và nhân phẩm đã làm ảnh hưởng tới hình ảnh cá nhân hoặc hoạt động kinh doanh của nạn nhân. Nguyên nhân có thể từ sự ghen tức, đố kị ban đầu, hoặc cạnh tranh trong kinh doanh nhằm đưa thông tin  lên Facebook cho bõ tức, cạnh tranh không lành mạnh mà dần dần lấn sâu vào vi phạm pháp luật lúc nào không rõ. Những vụ việc này nếu người bị hại chứng minh được thiệt hại do những thông tin không đúng sự thật gây ra thì người thực hiện hành vi đó không chỉ bị phạt hành chính, đền bù thiệt hại về dân sự hoặc thậm chí bị xử lý hình sự theo quy định.

Thực tế những vụ việc tung hình ảnh, thông tin với mục đích bêu xấu, hạ nhục người khác trên Facebook đã gióng lên hồi chuông báo động. Đã đến lúc xã hội và các cơ quan pháp luật phải tăng cường cảnh báo, đồng thời các chủ nhân của các trang mạng xã hội cũng phải tự nhận thức được các hành vi nguy hiểm khi cố tình lợi dụng các diễn đàn, mạng xã hội nhằm mục đích bôi nhọ danh dự, nhân phẩm cá nhân, tổ chức, xâm hại đến các quyền và lợi ích của cá nhân, tổ chức được pháp luật bảo vệ. Chỉ có như vậy mới giảm thiểu được mặt trái của mạng xã hội và bớt đi các vụ phạm pháp phải chịu trách nhiệm pháp lý về hành vi vi phạm pháp luật trong thời đại công nghệ thông tin phát triển như vũ bão hiện nay.

Tội làm nhục người khác (Điều 121 Bộ luật Hình sự):

“1. Người nào xúc phạm nghiêm trọng nhân phẩm, danh dự của người khác, thì bị phạt cảnh cáo, cải tạo không giam giữ đến hai năm hoặc phạt tù từ ba tháng đến hai năm.
2. Phạm tội thuộc một trong các trường hợp sau đây, thì bị phạt tù từ một năm đến ba năm:
a) Phạm tội nhiều lần;
b) Đối với nhiều người;
c) Lợi dụng chức vụ, quyền hạn;
d) Đối với người thi hành công vụ;
đ) Đối với người dạy dỗ, nuôi dưỡng, chăm sóc, chữa bệnh cho mình.
3. Người phạm tội còn có thể bị cấm đảm nhiệm chức vụ, cấm hành nghề hoặc làm công việc nhất định từ một năm đến năm năm.”

Tội vu khống (Điều 122 Bộ luật Hình sự):

“1. Người nào bịa đặt, loan truyền những điều biết rõ là bịa đặt nhằm xúc phạm danh dự hoặc gây thiệt hại đến quyền, lợi ích hợp pháp của người khác hoặc bịa đặt là người khác phạm tội và tố cáo họ trước cơ quan có thẩm quyền, thì bị phạt cảnh cáo, cải tạo không giam giữ đến hai năm hoặc phạt tù từ ba tháng đến hai năm.
2. Phạm tội thuộc một trong các trường hợp sau đây, thì bị phạt tù từ một năm đến bảy năm:
a) Có tổ chức;
b) Lợi dụng chức vụ, quyền hạn;
c) Đối với nhiều người;
d) Đối với ông, bà, cha, mẹ, người dạy dỗ, nuôi dưỡng, chăm sóc, giáo dục, chữa bệnh cho mình;
đ) Đối với người thi hành công vụ;
e) Vu khống người khác phạm tội rất nghiêm trọng hoặc đặc biệt nghiêm trọng.
3. Người phạm tội còn có thể bị phạt tiền từ một triệu đồng đến mười triệu đồng, cấm đảm nhiệm chức vụ, cấm hành nghề hoặc làm công việc nhất định từ một năm đến năm năm.
